Private mode is when an individual uses an incognito internet browser tab, where one's activity is supposed to be kept private.
The class action reportedly claims the search engine has been doing this since June 1, 2016 on "millions" of Google users through its applications and website plug-ins. The suit was filed in the federal court in San Jose, Calif. and seeks damages amounting to at least $5,000 per user.
Google spokesman Jose Castaneda said the company will defend itself against the claims, reports said.
GOOG slipped by 0.2% in recent pre-market activity on Wednesday, while GOOGL shed 0.5% Tuesday after hours.
